1. Agreement to Terms

By accessing our website (x-funity.com) or downloading, installing, or using our mobile application (the "App") from the Google Play Store, you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. License to Use Our App

Subject to these Terms, XFunity grants you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the App for your personal, non-commercial use on a single mobile device owned or controlled by you.

3. User Content

Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post to the Service, including its legality, reliability, and appropriateness.

You retain any and all of your rights to any User Content you submit. By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service. This license is for the sole purpose of operating, developing, providing, and improving the Service.

4. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Posting User Content that is harassing, defamatory, obscene, or that infringes on any third party's rights.
  • Reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code of the App.
  • Using any automated system, including "bots" or "spiders," to access the Service in a manner that sends more request messages to the servers than a human can reasonably produce.

5. In-App Purchases

If our App includes in-app purchases, they are processed through the Google Play Store and are subject to its terms and conditions. We are not responsible for the payment processing or any issues arising from it.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, and limitations of liability.

7. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. XFunity makes no warranties, expressed or implied, and hereby disclaims all other warranties. In no event shall XFunity be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use the Service.
